Honestly I don’t know a thing about Multimedia laws and regulation let alone trying to understand what in tarnation are they writing about. It has become a concern when of late I have been writing blogs on politics which many people up there are not comfortable with. 
According to an MCA run news media, the Home Ministry, via the police, will collaborate with the Malaysian Communications and Multimedia Commission (MCMC) and the Malaysian Cyber Security to check social media content which violates the law.

A new broom will most likely neglect the various embezzlements reported by Auditor General whilst he was a Defence Imbecile. The monetary exchange in kick-backs and scandals revolving the controversial “Scorpene/Perimekar Gate” most likely will never see daylight. More will continue with the acquisition of Rafale Eurofighter, stealth tanks and god knows what else.

Zahid said the immediate action was to ensure that information channelled by individuals or cyber groups through Facebook, Twitter or blogs were transparent and correct, as the exemplary UMPORNO operated Utusan Malaysia and Barisan Pengsonglap Harta Nasional’s funded PapaGomo.Com and their associated CyberMorons.

Although they have tunnelled their vision on the 'Red Bean Army' group which touched on matters contained in the Sedition Act concerning racial sensitivity, as well as slanderous content that exceeded legal principles, mooted by Prime El-Munafiqi the autocratic Bangladesh elected Government will look into others whom have been successful exposing their corrupted practices if they can twist and turn contents to be justified as slander and sedition. Therefore, they (MCMC) will most likely use the Multimedia Act 1998, Akta Hasutan 1948 and Kanun Keseksaan to their full advantage.

Akta Hasutan 1948 (The Sedition Act 1948)
The Sedition Act in Malaysia is a law prohibiting discourse deemed as seditious; inciting or causing people to rebel against the authority of a state or monarch. The act was originally enacted by the colonial authorities of British Malaya in 1948. The act criminalises speech with "seditious tendency", including that which would "bring into hatred or contempt or to excite disaffection against" the government or engender "feelings of ill-will and hostility between different races". The meaning of "seditious tendency" is defined in section 3 of the Sedition Act 1948 and in substance it is similar to the English common law definition of sedition, with modifications to suit local circumstances. The Malaysian definition includes the questioning of certain portions of the Constitution of Malaysia, namely those pertaining to the Malaysian social contract, such as Article 153, which deals with special rights for the bumiputra (Malays and other indigenous peoples, who comprise over half the Malaysian population).

Meaning: Don’t say bad things about the government or their institutions but you can express your opinion about a person. As an example one can say that the Prime Minister of Banglasia is liar, stupid and/or idiot, and he/she cannot be charged as these are not “hasutan” but an opinion which one can effortlessly prove it as a fact.

Kanun Keseksaan (Penal Code)
Penal Code (Act 574) provides punishment for criminal offence committed within Malaysia and even for offences committed beyond Malaysia, in the same manner as if such act has been committed within Malaysia. This is provided for by section 3 of the Panel Code (Code).

It was revised in 1997 and published as Laws of Malaysia (Act 374). The said Code came into force throughout Malaysia as early as 31 March 1976. But even prior to that date the Code was ineffective from 1936. Since then the Code has been amended on 32 occasions, all of which are incorporated in this publication.

Chapter XVI of the Code provides punishment for offences affecting the human body (life). Under this chapter, section 302, provides the maximum punishment for the offence of "murder", in which punishment for murder; whoever commits murder shall he punished with death.

Other instances affecting the human body, just to mention a few, selected randomly are assault, cheating, criminal force, defamation, physical hurt, incest, kidnapping, rape, robbery etc.

The Code, inter alia provides punishment for many other offences, including offences relating to, abetment, criminal breach of trust, insult to the modesty of a person, public nuisance, unlawful assembly etc.

Penal Code (Act 574), clearly defines what are the criminal offences and the punishment for such offences. Further the Code provides that under section 511, even an attempt to commit an offence is equally an offence, punishable with imprisonment.

This however takes a different perspective for social network. By this code, with an exception to those underlined, you can say or do anything you want to a person as long as your words does not cause any of the above consequence.

Communications and Multimedia Act 1998
Because both the above is disputable in a multimedia sector given to a smart lawyer (if any), and the fact that the people have now access to the huge and powerful alternative news, the government cooked up  the Malaysian Communications and Multimedia Commission (MCMC) or Suruhanjaya Komunikasi dan Multimedia Malaysia (SKMM) as the regulator for the converging all soups into a communications and multimedia law. Its key role was the regulation of the communications and multimedia industry based on the powers provided for in the MCMC Act (1998) and the CMA Act 1998 (Communications and Multimedia Act 1998).

The Act unfortunately is made so complex that it mostly protects the user and their privacy. This in fact could be good news as it can disqualify both the latter “Akta” and “Kanun” when you are writing on a blog or Facebook. Besides that, the act mainly charged with “overseeing” the new regulatory framework for the converging industries of telecommunications, broadcasting and on-line activities, against fraud, bugs and hacking.

Anyway, the reliability of these laws is best not tested – just for the inconvenient sake although there has not been any “litmus test” to date, and I sure don’t want to be the first. I encourage Zahid, PDRM, MCMC, CMA, MCA, DCA and the YMCA to test it out on PapaGomo and King Jason.

Looking back on the sole purpose of my interest in blogging, I am surprised to see myself deliberating on politics, compared to my main intention to explore self-development and positive mental attitude. Politics was not my favourite, not since 2008. Still back then I was beginning to notice the various deception of the ruling political party with various rhetoric’s but only to loot the nation’s wealth from behind. In consideration of “Akta Hasutan 1948”, I can’t write freely of what I think about our politics. Therefore I post herewith my intended upcoming post production movie climax.

Disclaimer: Everything I state in this post are the figment of my imagination for the movie “BLACKOUT #505: What happened after 5:00pm?”

My story would begin with that the cabals having prepared with more than eight plans to handle GE13. That there has not be any more disgusting Prime Minister of Malaysia ever than the current scumbag (excuse my French) who had helmed the nation for 4 years out of chance, nor elected. Perhaps it was the negative aura his wife been radiating. Thriving in a platform of looting, conveniently setup by Tun since 1981. Tun was one heck of an intelligent leader, brave and downright arrogant – but in a likeable way. The opposition in the height of campaigning claimed the May 13th (1969) incident was an elaborate “False Flag” of his. At that time Dato Harun Idris was his lapdog. It is being repeated now again by supposed to be Ibrahim Katak. Unfortunately Ibrahim Katak could not complete his task as his political career was assassinated by the people of “Pasir Mas”. Therefore the Prime Scumbag has to do it him-self or risk losing his job (or life).

It would not have mattered where in this 13th General Election (GE13), the tyrants won by choice of the rakyat. If so we would have accepted the defeat and move on. The irony is that they won from blatant gerrymandering and cheating by the Election Commission (EC). The EC and the Police has been in on it all along. From dropping ballot boxes from helicopter, sneaking boxes after boxes from Police vehicle trunks, hidden within schools (polling stations), toping with hidden boxes from warehouses, shop lots, from even EC employee’s home and the grandest of all, and the mysterious blackouts. The manipulating of Form 14 and subsequent documents that was altered blatantly at the 11th hour, pushing result announcement way late midnight, and concluding on simple majority win for the ruling cabals.

To Pakatan Rakyat and NGO’s investigating the fraud, understand that the “Project Bangla” itself is not the key factor for the cabals win. Project Bangla was just a deception for the people and the opposition. That we will fall for it and upon investigation, the courts will find no fault as the constitution says any person with a legitimate Malaysian IC can vote in Malaysian Election. Meaning, if your drag a cow with an NRIC into the polling station, legally that cow is eligible to vote. Therefore, the focus should be the “magic hands” after 5:00pm, what happened?
But why is that the fraud complexity is getting more intense in elections after elections? Why GE13 is so bad that the level of fraud is echoed throughout the world? A short recollection, the Prime Scumbag did say the he will do whatever it takes at whatever cost to retain Putrajaya. We all heard it but failed to listen. To listen what he meant by that and what possibly does he have up his sleeve to accomplish it.

Knowing the ground swell of Pakatan is too big, he had (with some help) been working on some plans, from Plan A, Plan B, Plan C probably right up to Plan Z. These plans are crucial to their survival. Should they lose Putrajaya (control of government), the people will look out, extradite, charge and appropriately sentence the guilty incumbents - going back to 1981. With an exception Taib Mahmud where there is an overwhelming public interest to start from the date he was born.

Therefore, if Pakatan takes over, whether or not Datuk Seri Anwar consent’s to it, others will ensure that the entire corrupted ministers are extradited from anywhere in the world, charged and either sentenced to life imprisonment or death by hanging. Three ministers are high on the death sentence list while many will spend the rest of their lives in prison.

The thought of it is frightening enough to device multiple plans. After much cross examination and fine tuning, which delayed the dissolution of parliament, Plan A rolled out (Project IC Disclosure), then they launched Plan B (Lahat Datu) giving them time to work on Plan D (Project Ballot i.e.: Blackout). Plan C? Well that was Project Bangla to “stupidify” Malaysians, which wasn’t actually an interest of theirs.

The cabals usually go into thinking mode only when there is money (a huge some) is involved or their life is threatened. OK porn is another motivator but in my movie; I will highlight only that the “end of their looting career” seemed to have awakened these “dcik heads”, to come up with the eight plans. In my opinion, in the entire line up of the cabals, there is not a single person competent enough to develop such an elaborate scheme. But who - Prime Scumbag? No way, he is too dumb. Batu Api? can’t be - because in his entire career in politics, his only been saying the wrong things. What about Cow minister? Neh, in my movie she will be portrait as the Prime Scumbag’s bimbo. I think, the magic could have been orchestrated by the one and only genius alive. Yes, you guessed it, that’s him – the same person back from the dead.

Based on my movie climax, it would be great if NGO’s can forget on deciphering their Plan C and focus on Plan D and the gerrymandering instead where the main juice is. Pending which, Plan E will proceed to stir racial tensions to allow preparation to Plan G (Projek Bungkus), where opposition’s cases will be effortlessly disqualified and everything will seem normal and legal. And that we wait to fight another day.

They will launch the rest of the Plans but I need evidence in my movie to say that Plan G had failed and an entirely new Plan emerges, “Project Merdeka Rakyat”. Therefore NGO’s, your hard evidence are in the episode “What happened after 5:00pm?”

In the meantime, to dismantle their Plan G, the people turn up in mass numbers to support DSAI to stop it. To declare GE13 was illegal. The cabals have penetrated into Pakatan and trying to use a weasel to dismantle Anwar’s efforts.  Untill then lets sit back and watch how Plan F unfolds. How our “Batu Api” will ditch the Prime Scumbag.
